No story writing today, just the plain facts ! I need your opinion please.

Ive been coming to this site for several years. However, until last month I just started to write my experiences thanks to the encouragement of some others here. I have done several deals, I will start to share them if that is ok.

Back in Sept 2012 a wholesaler friend of mine called me and asked do I know any buyers for a property he has under contract. Now I always have buyers some more serious than others. So I told him yeah. However this buyer I was bringing to the table never closed the deal and the wholesaler contract expired. The seller said “no biggie,” ill just rent it out.

In December 3 months later I called the seller back to see if he still want to sell, he said yeah but I want $20k more than I did in September because I have renovated it and put tenants in it. My wholesaler friend told me “Bennie youre just wasting your time, that guy is not reasonable, id move on to something else.”

So five months from December I find an investor that wants that property bad. I negotiated a $15,000 assignment fee in it and call the seller back. The seller is so excited, and the buyer is also excited lol and so am I! The closing is in 3 more days. I was feeling a bit generous as usual and considering giving the wholesaler who gave up on the lead something, not sure how much.

Now in another post I wrote “$9,000 in 30 Days” I was explaining how I asked this same wholesaler dude to write up a different unrelated deal for me because I did not want to be on the contract for several reasons. The wholesaler said “ Yeah Ill do it and we can split it 50/50” well that’s not what happened he put it under contract and negotiated a $7,000 assignment fee, of which he gives me a $2,000 fee. It was supposed to be split $3,500 each but he kept $5,000 and gave me $2,000. But I didn’t get that in writing simply because I wanted my name nowhere on this contract. So I took him at his word. I feel like he shorted me $1,500.

Just a stroke of chance the deal concerning the $7,000 fee closed first. I see how he went back on his word and he justifying it by saying “Since your name wasn’t on the contract that’s why I gave you a 2k bird dog fee” I’m thinking to myself ‘Dude if it were not for me you wouldn’t have made a dime on this not to mention the $5,000 I feel he is hoarding.’ So, I smiled and calmly told him “I don’t think that’s fair and told him thanks for the $2,000 fees have a great evening.” I’m pretty easy going, sometimes people think that’s a weakness however the universe and God continue to bless me.

If the deal where I negotiated the $15,000 assignment fee had closed first I would have told him I resurrected that deal and made it happen and would have paid him something since he was the orginal one six months ago who told me about the seller.

It comes down to this, at the end of the day I’m an ethical being with a conscious, fair and giving, also I have to sleep at night. Another trait some see as a weakness.

However, do you think I should give this guy any proceeds out the 15k deal I never gave up on? Should I feel like he shorted me $1,500 on the other deal?

He has no idea I never gave up on that other deal and is making a $15,000 assignment fee in 3 more days. If the $15,000 assignment deal had closed first, I would have given him maybe $2,000 out of it. I know now he wouldn’t have done that for me. However I just want to do the fair thing for my own conscious.

Here are my thoughts on that. Your "friend" screwed you on the other deal. What a jerk!

You are not a jerk or you would not be torn over this. It is worth giving him something on this deal, so that you don't feel guilty. Your conscience will be clear.

I always told my girls (and still do), "Don't bring yourself down to their level."

Funny, another DGer called me this week, really aggravated over something that happened (and rightly so) and I gave him this very same quote!

How much would he have earned on the original deal? $2k?

I see it as part of the Original. He had a seller and needed you to bring him a buyer.

His contract expired, but he started the ball rolling. Since you are completing the deal, he still deserves a token of appreciation.

Had he not screwed you over already, I would have said give him the $2k. Now I say give him a small token of appreciation.

Karen you’re right. I refuse to bow to their level. I have to admit one part of me say " Screw Him" another part of me say "Bennie give him $1,000 and watch his expression when i tell him Im making $15,000 on that deal this Friday and didn’t want to screw him over"

Who does this? Who burns bridges? This wholesaler must KNOW I will call someone online to put a property under contract before i call him again to make an easy $5,000"

However, if i give into the Angel placed in my heart by my Mother, how much should I give him. Im thinking $1,000. Since I feel he screwed me over I don’t have much compassion for him right now. I think it would be fair to give him nothing. I just need to be sure. Karen what would you do in this situation.

I’m not perfect by a long shout, however i do believe in Karma, I just don’t want to be screwing this guy over like I feel he did me. Then again is he right? My name was nowhere on the contract, but I expected him to spilt the assignment fee with me 50/50 when i was telling him about the house for sale.

Also, Karen Ive already chosen you as a friend and have the highest regard for you if you didnt already know Smiling

Mike, yes another lesson learned. I should have had some sought of agreement between the wholesaler and I. The seller was a friend of mines, and the seller knew he had to sell it very cheap because of the reapirs and a time constraint.

So I did not want my name on anyyyyy of the paper work. I didnt want even the remote possibility or chance of anyone coming down the road and saying i took advantage of a situation and a friend.

So I let him negotiate with a neutal person who was the wholesaler in this transaction.

Lesson learned, if the situation arise again, ill have to come up with something different.

On that orginal deal when he first introduced me to the seller of that property he needed a buyer for, if my buyer I bought to the table had actually closed...we would have split a $3,000 assignment fee.

Don't get me wrong! I agree TOTALLY with the "Screw him" mentality. I just know that it would bug the heck out of me.

I would give him the $1k and never have anything to do with him again. EVER!

This way you will not feel the qualms of "Did I do right?" "Should I have done...?" You have closed the book on him and you have done it with integrity. You will make that $1K many times over.

Thank goodness it was not a more expensive lesson. You have learned to get everything in business dealings in writing. Even with those you assume to be friends. Many of those that we think are friends are merely acquaintances.

Don't give up trusting in people. Most are good.

You know what Bennie some people are like that they only think of themselves. The two of you worked on this deal and then he goes behind your back and changes it and instead of giving you 50% or 3,500 he only gives you $2,000. I'm like you Bennie I am a man of my word, when I make a deal I stick with it no matter what. I think that the only fair thing to do is give him $1,500 which is what you feel he shorted you and call it even.

I agree with Karen on this one. Give him what you feel is appropriate, and be done with him. Maybe you shouldn't tell him how much you made as he may try and get more or try and bad mouth you. I mean he doesn't sound trustworthy and people always seem to come up with something to shock you. I would really not have anymore dealings with him, since he did not stick to his word in your first agreement. Keep us updated!

BTW Mike; I didn't know you lived in my neck of the woods; you must since I have met those same people on the road!

yeah I agree I think I should give him something out of the $15,000 deal thats closing Friday, however am I mature enough to actually do it? Im not sure yet, Im still pretty disappointed in his greed. Only time will tell.

Thats an important concern also Im having. I know he is going to researchhow muchit was sold for and realise I madepretty good on the deal. Although he isnt going to know how much my assignment fee was, im pretty sure he can figure out I made out good.

What hurts the most is him and I were pretty good buddies when we got together for business. I never hung out with him except for Real Estate so it wasnt like he was really close to me.

Doesnt he know I will never call him again? I mean really? You would burn a resource and business relationship for $1,500?

I have another deal I need wrote up next month that I dont want my name on. Before i call him, I would sign the deal in my own personal name 1st.

Sometimes...

Sometimes you just have to shake your head at other people's stupidity. They don't look at the long term. The funny thing is, he probably really believes that all is well.

If it were me, I'd like to

If it were me, I'd like to think that I'd be able to get over my emotions, give him $1500 (how much he shorted you), not saying anything about it, and then not ever interact with him on a business level again. Kind of a "fade off into the sunset" kind of approach.

Id like to think I can get over my emotions also, and look beyond how he felt the need to withold $1,500 from me. Who knows maybe Ill get past it.
