Real estate related, but personal. As some of you already know, my condo was about to go into foreclosure after I had to take early retirement in 2010. I made payments as long as I could, but I knew eventually I would lose my home. The first mortgage company I had was Chase. Then it was sold to another company and another company. This last mortgage company has been working with me to do a deed in lieu. I thought this was my best option because it will only hurt your credit for 2 years as opposed to 10 years for a foreclosure. They told me it would be April before they would have all the paperwork ready. That was over 6 months ago. They were even going to give me $3000 cash to start over. That's not much, but better than nothing. Okay, so I have been living here rent/mortgage free and I can't complain about that! But a few weeks ago, I got a call from my present mortgage company's deed in lieu rep. He told me that there was a problem with the title and they were trying to get it straightened out. He said it was not anything I did, but the former owner. He said something about a POA and that they were getting it resolved. Then last week I got another call from him and he stated that they were about to get the title issue straightened out. I thought okay, now it will be a matter of time. However, today I received a letter from the law firm that is handling this and they informed me that due to a title issue, I was not eligible for any kind of modification including Deed in Lieu.
They're giving me 30 days to appeal or file an answer. I cannot afford an attorney so that's out of the question. Does anyone know what I should do now? Do I have any recourse at all against them?
Oh, and I also received a postcard last week about a class action settlement against Chase because of the robo signing issue. This is in addition to the current issue with the current mortgage holder, but just thought I'd tack it on. Maybe someone knows something I don't about what I need to do next.

Wouldn't a problem with the former owner be an issue for thej title insurance policy?

with the title would be covered by your title insurance policy, so long as it doesn't exceed your purchase price.

have you tried the HUD counseling; it may be a start...
there's also some short sale companies that can help you; even though it may be a bit late, you never know...

I'm sorry you're in this pickle. If you signup with Legalshield, they should be able to help or at least point you in the right direction, on a case by case basis. They're worked with me on a rental issie I had with the aapt. complex I live at, and I am getting advice about a family law case, too It's like $29 a month, but worth it. I can call and talk with/email lawyers anytime.
POA sound like a Power of Authority or Power of Attny. Get them to shoe you in writting/proof there's a problem. If not, give them the "I will have my lawyer call you." line. It's works wonders, let me tell you.

The reason is your title insurance policy is the most recent issued; therefore it would cover any previous liens prior to your closing. Produce your title insurance policy & give them a copy, if you can't find it, then contact the title company or lawyer that did your closing ... they would have it on file.
i have to say legalshield is soooo cool. i used to be an associate and i love there product. if you can pay the monthly fee of like 17 29 dollars you can talk to a lawyer on the phone about your problem today. i would call alex click on his website. it gives his number. i've never met alex or talked to alex i just simply am familiar because i know the legal product great company. it's totally legit. i promise. if you should need to go to court they can do that as well. a certain amount of hours are included in your monthly fee. well i hope this helps.

I am not sure how to put this correctly so I'll throw it out and let more qualified posters elaborate on it.
We have all heard about homeowners demanding proof of title from the lending institutions and ending up owning the property free and clear because of the problems stated above. I am not saying this is going to happen for you but it gives you time and forces your bank to either get their .... together or ? I don't know full details of what to demand but remember seeing reference to it here at DG somewhere. Anybody???

No, I haven't called them. I thought at this point it would be a waste of time. They only help you to find housing and help you with your credit problems... which I don't have except for this one! We went through the short sale thing and it was listed for almost 4 months before they took it down. I knew it wouldn't sell because they were asking too much. I know other condos here that have sold way below what I thought MV would be but I'm sure they were foreclosures.

It's a Power of Attorney. He told me that much but didn't tell me the exact problem. I'm thinking the power of attorney was not proven or produced when we had the closing. I have to get all my materials together. Most of the information I got about the problem was on my voice mail so I have saved all the messages. He would always call early on Monday morning (before I got up) and leave a message. He called me every week up until the last 2-3 weeks. The funny thing about the letter I got from the law firm was it did not show my current mortgage holder as the defendant in the case. It showed BB&T so I guess that means they have sold my mortgage and I was not even informed about that. Could explain why they haven't called me lately.

Yeah, I hope the person you're referring to that talked about it will read this and give me some advice. I wish I knew who and what to address but at this point, what recourse do I have other than get my own attorney? And they definitely need to get it together. Before I was assigned to the DIL guy (or he was assigned to me) I would get calls every week from a different person asking me what I had decided to do. This went on months after I had done the paperwork for a short sale. It's like they all had a different set of documents and information and no one's information matched anyone else's. I have buyer who is looking for a quick sale on a 2 bed/1bath home or trailer in the country of the town I live in. I also have a very motivate seller of 2 houses that she need to sell because she is relocating. I have a few questions.
With the Buyer, I would like to find the 2bed room 2 bath home, get it at a cheaper deal and sell it to him and make at least 20K off of this deal.
Question: After I lock of the deal what is the next step?
What would you suggest would be the best way to go with this?
On the 2 houses
I need to find buyers, can you assist me with finding them?

your attorney would be in your state of s c. this is your law firm - Merritt, Flebotte, Wilson, Webb & Caruso, PLLC. they are a real law firm outside of legal shield as well. but i love the product for the phone calls and the peace of mind. they have helped me many times.

they are in columbia sc. i know the the first thing after you join is you would be able to talk to your attorney by phone and get all your questions answered and he/she could advise you.
