Hi all! This is my first journal entry.....wait till you hear this......
Found 1 property for $149,900. 2 BR/1 B & submitted an offer for $50,000. Their realtor said that the property was worth more than that, but submitted it anyway. After a few counters, they finally agreed to $100,000 with probate approval. The papers were submitted to the probate attorney, who now says that the price was way too low & that he is going to offer the property to the other family members to see if they would like to purchase it at that price. The attorney felt that if this property was going to be "given away" at this price, it should go to a family member. What????? Isn't the function of a probate attorney to make sure that the will and assets are distributed properly? So here's the $100,000- go distribute it. Our realtor is livid. So are the sellers. Anybody have any ideas? Or opinions?
Now the 2nd offer was for a foreclosure, way below market value. We put in our "best & final offer" but upon hearing that there were 4 other offers, I had 2nd thoughts. My husband called our realtor and she said she would see what she could do, but she said that the other realtor did say "best & final offer". The bank's realtor was very arrogant & flatly refused to hear of any price increase on our offer & said that it was already submitted. Basically she said "tough luck". Well, I began researching & discovered that the attorney for the party that was being foreclosed on also handled some property transactions for us about 25 years ago. So we called him and explained what the bank's realtor had said & he told us to call that realtor & tell her that she is obligated by law to submit all offers and any changes to those offers to the bank. The bank's realtor was unusually "nice" & told our realtor that SHE got the bank to consider our other offer. Now, wasn't that unbelievably gracious of her??? lol We still haven't heard yet. But I must say, we are finding this to be so exciting!!!! We are having such a blast!!! So how was your day??????
Either you're doing everything COMPLETELY wrong, or you've caught a few people committing fraud. Either way, yikes.

Taking action and getting the offers out there is terrific! Don't forget the most important part! Start building your buyer's list.

Way to go, guys! Yes, every agent (I don't care what agency they work for) is responsible for submitting all offers received on a property in a timely manner, regardless of what the seller thinks about the offer, esp. a bank. If they don't, they are not going by their realtor code of ethics as a realtor, which states that once you become their client, they have to have your best interest at heart, treat your offers with care, and your financial information within the bounds of your business relationship. If they are caught doing anything outta sync, they could be subject to disciplinary action by the state real estate commission, local re commissioner and the local realtor board. So, the attny has your back! Nice.

So, we received a phone call from our realtor about the house that our offer was "too low" but accepted. Evidently, the probate attorney is also their family attorney who says that he has their best interest at heart. He now wants the offer to be rewritten on a Realtor Board contract (not on our realtor contract, which the board of realtors adopted) and he wants 21 things changed (there weren't even 21 entries on the contract)including not having our LLC to be buyer, but rather our names, wants us to put 10% down (even though we supplied a proof of funds letter), and he wants the assignment clause removed. He said that this deal is fishy......Our Realtor said that she never has seen anything like this before. The only thing "fishy" is why this attorney wants to do this to this family, who really wants to have this house gone. We have been the only buyers and because we offered so low and it was accepted, he thinks that we somehow beat her into submission? What are your opinions on this? Here's an update on the "too low" offer. I decided to pay the attorney a visit (his ad read that he gives free 10-15 min consultations). He proceeded to tell me how he didn't like the assignment clause in our contract. So I asked him how he would have worded it to accomodate an investor. He went from "you gotta get rid of this assignment clause" to "contract may be assigned by buyer subject to approval of seller". He's also OK about NOT putting down 10% now because I explained to him about this being a cash sale "as is" and I also asked him if he would be interested in becoming our attorney on a couple of other deals (of course this deal would be a conflict of interest)we have coming down the pike & how much he would charge. He was very accommodating & friendly. He did inform me that the probate procedure can be lengthy & time consuming and he emailed all 20 heirs about the sale of this home. We've come to the conclusion that if this deal is meant to be, it'll happen. In the meantime, We have another offer that we are waiting on and another 2 offers in the works. Che Sera Sera....This is fun! Our realtor is having fun too. She said that she never worked with clients like us before. She said that we think out of the box. One thing for sure--we wouldn't do what we are doing if it WASN'T FOR THE EDUCATION we received! Thank you Dean, Academy, & DG family!!!!!! Have an awesome night!
Thanks for the heads up. I'll be posting the progress of these offers on the Forum. I'm a Newbie and that way DG Family can tell me if we're doing anything wrong (or right). We need lots of encouragement.

We just had an offer accepted yesterday! Yeah!!!! It's the probate house on the market for $149,000 and we first offered a ridiculous amount of $50,000 (can't even buy land in our area for that amount). Anyway, we finally agreed on $100,000 when their probate attorney said that for that price, why not just give it a family member. Originally, he didn't like the agreed price, why was our LLC from Nevada (we live in CT), the assignment clause in the contract, the contract itself, he wanted 10% down upon acceptance,& the list went on. I went to visit this attorney and by the time our meeting was over, I had him accept our LLC, our agreed price, forget the 10% down and accept our assignment clause. I also told him that as a property investor, I could use him for closings & how much would he charge? So, the deal is on & left a message with an investor who has been actively buying up real estate in the area. WOW! What a rush! We can't believe that just 6 months ago we were in Dean Graziosi seminar wanting our money back & thank God your academy hooked us up with the Edge 2011 and later our coach Eric. Just 6 short months to our first deal and in CT, of all places! Thank you so much Dean, for opening a door to our new future! You are a very special person & we just want you to know how grateful we are. You Rock!

It is great that you feel so good about getting an offer accepted. Can you imagine how you are going to feel when the deal closes? That is the ultimate feeling in this business.
Keep getting out offers. That is a key to success. Do not sit and wait for this current offer to close.
Get something else in your pipeline.

Well, I think our realtor is getting the hang of this. Every morning we receive emails from her with 2 or 3 properties that are distressed or foreclosure pending. We just put in 3 more offers. First Offer is another probate house. I never thought that we could ever get properties this cheap in our area. I always thought that this happens to other people in other parts of the country. But after getting that last property for $100,000, we are definately not embarrassed to put in low offers. Second offer is a fixer upper and sold AS IS and the Third Offer is a foreclosure right next door to my realtor. It's funny, I've been looking at this house for about a year now & still hasn't sold and finally ended up in foreclosure. Wish us luck

We just finished with the inspection and managed to lower the price an additional $5,000. We now purchased this house for $95,000 and all 20 heirs signed off on it. Awesome! Got in contact with a contractor investor who wants more info on property. Just put in 2 more offers and another 2 were rejected, but they haven't sold yet. Giving it some time to sit on market for awhile (especially trying to keep heated for the winter) and like Matt said, try again in 30 days. Wow! This is so much FUN! Have an awesome day!
