Real Estate Agent Faces Temporary Restraining Order from Squatters Carole VanSickle | April 23, 2012 | 1 Comment A California real estate agent is having an unusually tough time selling one of her listings. The reason is not a difficult market or a tough economy; instead, she’s been banned from the property via a temporary restraining order that the squatters in residence have filed. “I cannot come within 50 yards of the home,” explains Melissa Case, the real estate agent who has been trying to sell the property via short sale since December of last year. The actual homeowner contacted her after he had already abandoned the property and asked for her help in selling. However, when Case arrived on the property, three people were living there without permission and without paying rent[1]. The squatters are demanding “proper eviction process” because they have established residency in the property. They have also produced what the homeowner and Case say is a false rental agreement. Case says that the police have also verified that the rental agreement is a fake, but that the police cannot take action because the issue is a civil matter[2]. She’ll be in court next week to fight the restraining order and hopefully have a short sale in the works at that time. Case says she has a potential buyer who is interested in the property as an investment. PS: Had to share this!!!

LOL! On the first thing, and I think I have heard of that Mike, so I guess it is really not anything new is it? I don't know if this is the same case, but I think I heard something within the last few months about somebody doing this. There are also people living in million dollar homes and collecting government assistance. Crazy.

Squatters rights is still in existence, but I don't know the time frame. You would need to look it up for your state as to how long they can live there before they claim squatters rights.
Everything works out in the end. If it hasn't worked out, it's not the end.

a couple years ago a guy in my IN REIC had squatters. he never thought about locking the place up while he rehabbed it. duh! he had to actually take legal action and it cost him about $3000 to get them out. maybe that is something we investors should start taking action against with our governments????

To bad this can't be handled the way it should be. We as a country have gotten to soft with everything, thats why folks KNOW they can get away with this sort of thing.
I did hear a good story the other day, there was a woman who was squatting in a house and court was weeks or so out, so the owner paid 2 monster rough looking dudes to move into the house also. Once the lady saw them moving their stuff in and planning on staying, she had a truck out front moving her crap out asap. Problem solved!

It is a shameful situation w/all of the lost jobs/homes; maybe all parties can work something out, like "lease option"! Granted someoneelse wants the home, but given the situation? I have known of issues concerning "squatter's rights", usually a rightful owner's abandonment of 7 yrs. has to be shown, following by the "homesteading" claim; I would think it rare for a property not to be visited in a 7 yr. span. Keep us posted on this one, a learning experience for everyone!

I did hear a good story the other day, there was a woman who was squatting in a house and court was weeks or so out, so the owner paid 2 monster rough looking dudes to move into the house also. Once the lady saw them moving their stuff in and planning on staying, she had a truck out front moving her crap out asap. Problem solved!
The USA has gotten too soft - matter of fact they want to 'Do away with the Death penalty' .....WWHHAATT...... so what the convict killed/raped your whole family and the Dealth Penalty is "cruel and unusal punishment"....give me a break! Take them outback and off with their heads or just bring back public hanging and save BILLIONS of $$$$$$$$$$$ and save the cost of prisons.
Our Soldiers endure cruel and unusual conditions daily without being convicted of a crime in efforts to protect and keep citizens of the USA safe.Many killed in action and lost at sea and away from their families for long periods of time. Their meals and living conditions are not the best by any means much less being able to have A/C and cable and not do anything like the convicts daily.
Its TIME to CLEAN up America!
