is it legal? she needs to know

i'm GOING to be a real estate investor.
i have found properties that my wife has not been able to find.(she's just gotten her re liscence for md.)
she has a way with people however and has buyers.
i'm telling her i'll find and lock up the properties and she can bring the end buyers,be their buyers agent and we all get paid.
her issue is this,i'm trying to tell her we can do a double close and she's saying i can't sell to a buyer when i don't own the property.i say with a signed contract i have equitable title and the right to sell.
maybe i'm not explaining this right to her or maybe i have it wrong altogether and she's right.
i know she and i can do great things together if someone other than myself(since i'm new too,lol)can let her know that what we're trying to do here is legal and ethical.
please,we need answers for her to know that she's not breaking any laws or being unethical in any way.

Double closing are legal

In some ways I see were she is coming from, But from her point of veiw I would talk to anohter realitor and see what they say, Wish you the best of luck.

Contract

Tell her you don't own the house.You are not trying to sell a house....you are simply assigning your interest in a contract. That is why it is called "Assignment of Contract." When the owner signed the contract along with your signature you created interest. You are selling your interest in a contract to an investor or retail buyer for $$$$. It has been going on for hundreds of years. And what justplaine said above is true.

First things first...

she has to see if her broker is ok with something like that and if she can't explain it and is not easy with it, how do you expect them to be???

And expecting her to read his books and immediately understand and grasp right off the bat might be too much in such a short period.

What I suggest YOU do is understand better on what you're trying to explain, because you're obviously not selling her and if you can't sell her, how can she be expected to do the same to someone else???

Let her get settled while you get to know what you're talking about

she understands what i'm talking about ,but she hasn't done this sort of thing and wanted to make sure it's legal.she also knows i'm new and wanted to hear from others,not just me.people with more experience.
she talked with two more experienced realtors in her office about this.
one knows absolutely nothing about a double close and the other one said she knows it's been done and can be done although she's not personally done one herself.i will keep learning always.keep moving forward,rob

Please don't take what I am about to say the wrong way. Your wife knows what they teach in re school, which certainly is not alot about what we do.

Those realtors who know what we do, most likely learned from us here. Anyway, there is nothing illegal about a double close. Some of the largest title companies in the United States do that.

You will need to take title first, then resell to a investor. This is known as the A/B and B/C which is prevalent when you use Transactional Funders.

Double Close

I have 2 title companys that will double close. Then there is Old School Title and the double close in all 50 states. It is not the Old School in Florida but their other branch in another state...I forget the state they are in.
