Are you asking if a house has a pending status is it a shortsale? If that is your question the answer is not necessarily. Pending status just means that there is an accepted offer and they are waiting (pending) for closing.

If the bank OWNS it already

It is an REO. If the owner is selling it for less than they owe the bank, its a short sale. Not sure if that's what you're asking.
