Zodas Agreement

There is a local Exit agency that we used to sell one of our houses a few years ago when we were in Alaska on vacation. After reviewing the HUD Statement,I noticed the fee, complained & was told it was in the listing agreement we signed ... so we couldn't do anything about it.
The beginning of this year we made an offer on an estate house that was listed with the same agency. The seller accepted & we were about to close the following week, when I noticed the same charge; I called them & refused to pay
it, they said it was a part of the closing costs, I informed them we didn't sign a listing agreement(they were getting an additional $ 149 from the seller also) so they could either eliminate the fee or stick it, & we would walk away from the deal & they could explain it to their client.
They dropped the charge & we closed !

I have been e-mailing back and forth with my agent on this HUD home. The agent asked me if I wanted him to take a $149.00 pay cut. I responded I do not want you to take a pay cut but I do not want to pay for some thing we do not need. I also asked if HUD should pay this fee.

Let the agent take the cut, just as general principles I personally wouldn't pay for it. Since the agent offered & is willing, go for it, they figure they'll make it up a your next deal.

I called the Coaches line and one of the Coaches said it is like a junk fee to help pay for the office help. I called my agent and he said he would not charge us that fee.
