POSSIBLE DEAL #1 WHAT SHOULD I DO IF THERE IS TENANT EVICTION IN COURT

This morning my agent/partner called me up like around 8:30am (He's hungry to make money with me lol) about one of the five properties which I made an offer on yesterday.

Subject Property: 3/2...Seller motivated and he leaves out of state and sold as is. Asking price:$185k... ARV: 220k....My offer was $165k with $5000 down payment after 4 days upon acceptance and no inspection period. Got pof from www.besttransactionfunding.com..

So basically my agent forwarded the email which the listing agent sent to him in regards to my offer to me and also with an attachment of inspection report which was done 08/27/2013. This was what the listing agent wrote to my agent "Thank you for your offer, please be advise that this property is tenant occupant in process to the eviction with the court, Buyer assumes occupancy status, if your client accepted this sale this way let me know also inspection report from city is attached."

So after talking back and forth with my agent on my offer. I asked him hey how much do you think this house is worth he was like $156k if it is a 3/1 which is says on the tax row. They both of us wasn't sure if they 2 second bath was done with permit or not and agent was like he could see a 4/2 in the remarks. My agent gave me the listing agent phone # and I called her immediately and left a voicemail.

Less than 5 mins later listing agent called me back and I introduced myself to her and asked her why her client is selling and she told me he wanna get rid of it quickly to use the money to do some other business ( not REI)but lives out of state (sounds motivated to me)..and I was like "hey I can see this house listing as 3/2 but on tax roll its 3/1 can you tell the condition?) I left her to keep talking lol..

Long story short she told me the tenant converted the family room to an efficiency which doesn't have any permit but the 2 bath has a permit and she got the document.

The only thing this house needs is kitchen updating which to me looks ok and the efficiency door has to be closed together with the rock sheet lol from the interior to then put in a door which will cost less then $10k. I told her I cant pay more than that house is worth. she was like they already got an offer before for $155k but the didn't like the entire tenant eviction in court. I was like do you think your client would consider an offer for $160k she was like she could try.

Possible deal number #1

Then my agent/partner called me and I gave him a feedback on the entire conversation I had with the listing agent.
So I told him to work on the contract and we are going to offer $160k with $5,000 down Payment after 4 business days with 5 days inspection and closing on or before 13 days from effective date.

Here is when it became funny. I asked/partner what does he thinks about this deal he was like it looks like a good deal and he thinks people are not trying to buy it because of the entire tenant eviction court issue. I responded positively and was like I love challenges like this and he was like what if I don't find a buyer lol.

I couldn't let him feed me with a negative thought. Then I was like "hey listen there is no WHAT-IF in my dictionary and I already got buyers like up for this up and as soon as we get our offer accepted I'm going to market the heck out of it:)

I will keep taking more action until I see results.
