Heres my question....I have a title company that deals mainly with investors. They told me that all parties involved in the back to back closings have to sign a sellers disclosure or afidavit saying they aware of the back to back closing. My question is if its a REO is anyone having problems with the bank agreeing to this? I soooo hate running into snags

I have never HAD to disclose to the bank or seller when I double close using transactional funds. I fully disclose to my seller anyway. I DO have to disclose to my buyer when we do a simultaneous closing (use the buyers funds to fund my purchase from the bank) I have never had to disclose to the lender, only my buyer. Get a title company that knows how to do this stuff, they are out there. If the bank finds out you are double closing, they may kill the deal. This is along the same line of reason the banks use when they do not allow assignments on REOs. I do these all the time! I am in Colorado.

I am also in missouri and I have done two double closings. One I had to inform the bank and the buyer. which they both approved. The other we disclosed nothing.
The first I used Mokan Title The second I used Superior Land title which is by far way more investor friendly If you are in the KC metro area let me know I will be glad to give you their number.

Awesome!!!! I would love their number. I have used Accurate Title. Do you know anything about them? Never had any issues but like i said just concerned about my deal being killed if the bank says no. Which bank approved it if you dont mind me asking?
