buy pre-4 and rent back

My realtor has brought a deal to me...it is a pre-4 comps for 220k, looking to do a short sale with the bank and have a contract written up with me for 150k.

but here is where I question it....The current owner wants me to rent it back to them at 1k a month. The husban is disabled and has no income. He may also be eligible for some subsidy towards his rent based on his disability.

They currently pay close to 1500 a month, but now cant afford it and are in pre-4.

How comfortable would you be renting back to someone in this situation? What if I wanted to sell in 1 year, and they had to move? With his disability I just wouldnt feel right about that. Also, would he have some legal right to make it hard on me to get them out, over someone who is not disabled?

The deal would only cash flow about $100 a month and I would NOT be able to refi and get my DP back! If I did, it would be a negative cash flow...

so what to do???

Are there any legalities against renting back to the owner, or is it just against selling it back on a short-sale?
Aside from that... I would be a little concerned with them making the rent payments if they are not making their house payments (whether it be for financial or other reasons). Also, with only $100 cash-flow with that $ amount of investment, I think I'd move on to something else if your goal is to buy & hold. Just my 2 cents.

thanks for the feed back. From a financial stand point I am right there with ya...move on. But I would hate to see these folks loose their home and then have to find somewhere else to live especially with his disability.

I probably am going to pass, unless the mortgage broker works some magic.

To answer your question it is only legalities against selling it back to them...

I would say if you can't come to a agreement with your broker,,then possibly re-assign it to someone else ,,or walk away ,,I know being disabled is tough but if I was in that positon and I knew I could'nt make my rent then I would sell and clear away my worries about bills and move to a lower rent and new start,,times are tough and I feel you have a chance to help this person ,,but it will be more of a "what is the right thing to do ,,not how much it profits kinda thing",,me I would help them enough to make sure that his family would be ok ,,,let us know ,,sry tough decisions ,,one day at a time.

I know you'd like to help them, but would it be a blessing or a curse for them to stay in a position where they would be struggling? If I was in that spot, logically I would probably sell and start over small to get back on my feet, especially if the husband has no income right now. Maybe at some point he'll be able to collect disability payments, and can build up again. Does that sound callous? I just know that when we've had to struggle in the past, the less expenses you have, you're able to feel more secure. Maybe if you can't help them out, a copy of Dean's book would change their view on what opportunities they might have. Actually, one of the chapters in the new book I was reading this morning had a message included to help people in this situation. I'll send you a pm, D, to read over and see if you can help these people with it.
By the way, I know they're gonna be posting info in here on how to get the book (at a discount for DG.com members). I don't think ANYONE wants to pass up getting one. It is a step-by-step manual on using Dean's strategies for today. It's like he sat down and just, in depth, went over every step to lead you to victory (AND help other people!), written of course like he's sitting there talking to you. Details, details, details. And he writes it with such understanding about how each of us reads, reacts, and uses information. I don't know how he can have so much insight into people and what they need to help them succeed. I hope I don't make him sound like an idol or anything, but I tell ya there are very few people I have as much respect for in life.

Oops, off the subject a bit...

Anyway, D, you have a good heart. I hope you can help them out, but keep going toward that next deal in the meantime. Smiling You're doing really great.
