intestate laws
My father died without will has a mortgage w USDA assumable loan. his widow and her son (my 1/2 brother) abandoned the house and took everything in it. Left a bunch of trash outside and all. She lied to me and told me no one could get the house. After coming across intestate laws for VA on the internet about a year later I called the mortgage. I filed in Franklin County VA for title but had to list all heirs including his widow and my 1/2 brother. I have one full brother and three 1/2 brothers, one 1/2 sister, and then 1/2 brother under age. How can I get around having them to sign a disclaimer to relinquish interest in property so I can assume the loan? Can I just place ad in newspapper? As for the 2 who abandoned property can I just file in court as abandoned property? Please help. The mortgage company says that I have still 6 months before looking at foreclosure.
